On April 29, 2005, the NAACP Legal Defense and Educational Fund, Inc. (LDF) filed a motion for summary judgment in the Eastern District of New York on behalf of African-American and Hispanic settlement beneficiaries in United States v. New York City Board of Education. LDF is seeking a ruling that protects its clients from being deprived of the job benefits they properly received as remedies for the Board of Education’s past racial discrimination in the hiring of school custodians. The brief argues the lawfulness of the job benefits received by Black and Latino school custodians under a settlement agreement that are now being challenged by white custodians and the Department of Justice.
