LDF Appeals Manhattan DA’s Failure to Respond to Information Request for Materials on Gang Database

The NAACP Legal Defense and Educational Fund, Inc. (LDF) today appealed the Manhattan District Attorney’s Office’s (NYDA) failure to respond to a Freedom of Information Law (FOIL) request for materials related to New Yorkers’ inclusion in NYDA’s gang database(s). FOIL requires New York City agencies to respond to a records request within five business days of receiving of the request, and the NYDA’s failure to do so amounts to a constructive denial of the request.

This appeal and the underlying FOIL request follows LDF and the Center for Constitutional Rights’ (CCR) recent FOIL requests seeking information about the New York City Police Department’s (NYPD) gang policing tactics. LDF and CCR also sent a letter to the New York City Council requesting an oversight hearing about the NYPD’s gang policing practices, which was just scheduled for June 11, 2018.
